Y’all are gonna shit on me for asking this, but jokes on you ‘cause that’s my favorite… What is the argument AGAINST red flag laws? I’m hearing more and more people that I consider level-headed consider the idea. Are those people sliding in an authoritarian direction? <3 you, r-words
One legal argument against them hinges on how you interpret the Fifth Amendment's "shall not be deprived of life, liberty, or property without due process of law" bit. Generally, "due process" refers to a trial, like one in which you get convicted of a felony and lose your right to bear arms. Red flag laws deprive somebody of that right without a trial (granted, on a temporary basis, but the point stands).
And they can take your property, and you have to fight the legal system at your expense to get it back.
