If I had to guess the shooter thought dead guy was reaching for his gun and that's why he fired so quickly. However dead guy had bear mace in his right hand (based on the position of his firearm, likely his draw hand). Therefore couldn't have drawn his weapon without first dropping mace, which in high stress situation, unlikely to do (most don't train for drawing when something is already in their hand).

It's tragic that the DA fucked him over liked that. It should be a clear case of self defense. However, we should also take the time to learn from his mistakes. After hearing about all the self defense shootings in Kenosha, New Mexico, Minnesota, and others there are a couple of things that we need to keep in mind.

1. Do Not Brandish. Only point your weapon at someone who is an active threat and you intend to kill. This is what got Garrett Foster killed and that dude in Wisconsin arrested.

2. Shoot to kill. If your attacker is dead, they can't testify against you.

3. No matter what political side you fall on know that no matter what, half the country will be against you should your shooting go viral. Don't give them anything. They tried to slander Kyle and dug up old dirt on him. Make sure your self defense gun doesn't have fucking Punisher skulls or edgy slogans on it. You better believe a leftist DA will fuck you for that. I know that we love custom patches here, but if you have a "Communist Hunter Party" or "Remember Rhodesia" patch on your kit and you are filmed killing a commie with that on, you just served a premeditated murder charge with a possible side of hate crime to the local DA on a platter.

4. If you know you are heading into a "hot" zone, have a body cam. You can pick one up for under $100 on Amazon. You don't want to rely on the footage of "peaceful protestors" to clear your name.

5. Lawyer fees are expensive. Have CCW insurance if you anticipate having to use your weapon. It can save you from bankruptcy.

6. No warning shots. Shoot only center of mass. Jake Gardner made that mistake and it's likely that the entire DA's case rested on centering the charges around that one mistake.

7. Cops are not your friends. Say nothing beyond "I feared for my life" and "I want a lawyer". Also stay off social media after the shooting. Make all accounts private or delete entirely. You will be doxxed, might as well make it harder for them.

8. Know your local gun laws. During the early days of the riots and man in Minneapolis got himself arrested defending his pawn shop. All because Minnesota is a duty to retreat state. Remember during a stressful situation you will have trouble thinking about the nuances of our legal system, but you know who won't have trouble. The leftist DA trying to put you away for life because you killed their "comrade". Know what constitutes viable self defense.

9. From all that we have seen it has become clear that the person that wins gun fights isn't the one with the best gear, coolest gun, or highest grade ammo. It is almost always the one that draws and fires first. A good holster and dummy ammo for dry fire training are probably the best investments you can make in terms of effectiveness.

Watching the video it is really impressive that a 17 year old kid was able to handle himself that well with a swarm of "peaceful protesters" attacking him like that. The video also really shows the importance of cardio over gear in those situations. I am not sure one of those fatties decked out in 5k worth gear could have gotten out of that situation
